Terms of service
By ordering any product or material, buyer hereby agrees to the following terms and conditions of sale: All orders are accepted and shipped strictly subject to these general terms and conditions and no other terms and conditions printed on buyer's purchase order or otherwise, shall be applicable to any order.
Prices and Payment Terms
All prices are in U.S. Dollars and are subject to change without notice. Freight and insurance are prepaid by A Chemtek and added to the invoice unless otherwise specified. Terms of sales are net 30 days from date of invoice. Written quotations are guaranteed for 30 days. We reserve the right to request advance payment in certain cases. The Buyer is responsible for bank charges for all overseas transactions.
Taxes and Other Charges
Buyer will be responsible for payment of all taxes, duties, excise, custom, inspection and testing fees and any other charge imposed by government authority.
Shipping
In most cases, orders are shipped via FedEx according to customer location and the requirements of the product transported. Chemicals will only shipped to verified commercial addresses, A Chemtek reserves the right to request proof of address and deny shipment as necessary.
Hazardous Chemicals and Liability
Many chemicals are hazardous. All of products should be handled only by qualified individuals trained in laboratory procedures and familiar with the potential hazards of the chemicals. All the compounds are intended for laboratory research purposes, and not for human or animal applications. The Buyer is also responsible for the safe disposal of all such compounds in accordance with current legislation.
Toxic Substance Control Act (TSCA)
A Chemtek does not warrant that its products are listed in the chemical substances inventory under the Toxic Substance Control Act (TSCA). The Buyer represents and warrants that the use of products purchased from Seller will be in full compliance with the act and its regulations.
Warranty
A Chemtek warrants materials to be of the stated quality at the time of sale. This warranty is exclusive, and Seller makes no other warranty, express or implied, including any implied warranty of merchantability or fitness for any particular purpose. The Buyer must inspect goods immediately on receipt and inform the Seller of any shortage or damage within 10 days. Quality problems must be notified within 15 days of receipt.
Returns
Buyers shall not return Products without Seller’s prior written consent. Seller reserves the right to inspect Products at Purchaser’s site and/or require disposal instead of return. All returns must be in compliance with Seller’s instructions and may be subject to a 20% restocking fee.
Certain Products (e.g. diagnostic reagents; refrigerated or frozen products; custom Products or special orders) may not be returned under any circumstances. Title to returned Products shall transfer to Seller upon acceptance at the facility designated by Seller. Any returned Products must be in their original packaging with the original label affixed, and unaltered in form and content.
To initiate a return, email orders@achemtek.com. Seller shall review buyer's request. If approved, buyer shall receive a return confirmation email containing the return label . After receiving the return confirmation email, you have 14 days to return the products. Any late returns will not be accepted.
Patents
A Chemtek products protected by use or application patents are not offered for sale in countries where the sale of such products constitutes a patent infringement and its liability is at Buyer's risk. Products currently covered by valid US Patents are offered for R&D use in accordance with 35 USC 271(e)+A13(1). Some products may be covered by application or process patents. The customer must be responsible for determining the existence of such patents.
Technical Data
The physical properties and other data about our products are obtained from our own data and from literature references. A Chemtek assumes no responsibility for the accuracy or completeness of such data. Buyer agrees that he has the responsibility to fully determine the accuracy and completeness of any technical data concerning any product or use.
